Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed by consumers or businesses through the online shop of Mondono GmbH, Robert-Koch-Str. 35, 55129 Mainz, Germany, email: info@mondono.eu.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Contracting Party and Conclusion of Contract

The purchase contract is concluded with Mondono GmbH. The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By clicking the order button, you place a binding order for the goods in your cart. Confirmation of receipt of the order is sent immediately after submission and does not yet constitute acceptance. The contract is concluded only when we expressly confirm the order or dispatch the goods.

3. Prices and Payment

All prices are stated in euros and include statutory VAT. The available payment method is PayPal. When PayPal is selected, payment is processed by PayPal Europe S.à r.l. et Cie, S.C.A.; PayPal's terms of use apply.

4. Delivery and Shipping

Delivery is made to the delivery address provided by the customer. Shipping is usually handled by DHL Paket GmbH or General Logistics Systems Germany GmbH & Co. OHG. Unless stated otherwise, delivery usually takes 2-7 working days. If a product is unavailable, we will inform the customer without delay.

5. Retention of Title

The goods remain the property of Mondono GmbH until full payment has been received.

6. Right of Withdrawal

Consumers have a statutory right of withdrawal. The withdrawal period is 14 days from the day on which the consumer, or a third party named by the consumer who is not the carrier, receives the goods. To exercise the right of withdrawal, the customer must inform us by means of a clear statement, for example by email. After withdrawal, the goods must be returned. The customer bears the return shipping costs unless otherwise agreed.

7. Returns and Refunds

After receipt and inspection of the returned goods, we will refund the purchase amount using the original payment method. Refunds are issued within 14 days after receipt of the return.

8. Warranty

The statutory warranty rights apply. In the event of defects, the customer is entitled to supplementary performance, either repair or replacement. If supplementary performance fails, the customer may reduce the purchase price or withdraw from the contract.

9. Liability

We are fully liable for damages arising from injury to life, body or health, as well as in cases of intent and gross negligence. In cases of slight negligence, we are liable only for breaches of material contractual obligations; in such cases liability is limited to foreseeable damage typical for the contract.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protections of the country in which they have their habitual residence.

12. Final Provisions

If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions remains unaffected.
